The FBI’s decision to execute a search warrant on former President Trump’s Mar-a-Lago home on Monday is ‘unprecedented’ – especially for a non-serving commander-in-chief and one who has indicated he could run again, a former special-agent told Fox News Digital on Monday.

“We just haven’t investigated presidents after they’ve served their terms,” ​​said Michael Tabman, former head of the FBI’s Minneapolis field office. “But it’s a huge move on the part of the FBI in that the political sensitivities are clear. Obviously they’re dealing with a very, sort of tenuous political climate when you go out and investigate a president, especially one who says he can run for office again.”

Trump announced on Monday that his lavish Florida residence had been raided early in the morning. Sources told Fox News Digital the search was tied to documents Trump had carried with him since he was president. Sources also said the National Archives and Records Administration referred the case to the Justice Department, which recovered 15 boxes of classified documents from the house.

But Tabman, who is now retired and not involved in the FBI’s investigation of Trump, noted that obtaining a search warrant “is no minor task.”

“You certainly have to, as most people know, produce probable cause…to first get prosecutors who want to write that down and present it to a judge – then present it to a judge who has to agree that you’ve shown a probable cause that a crime has been committed, there is evidence of the crime at the place you indicate and at the time you plan to execute the warrant,” he said by telephone. “So there’s a lot of information that you have to be very convincing to a federal judge and they’re looking at it.”

He called it “an excruciating, painful process to write this affidavit – you know, crossing the T’s, dotting the I’s, getting your approval both within the FBI and within the prosecutorial chain of command.”

“And there’s no doubt in my mind that it went all the way to the attorney general before taking it to a judge,” Tabman added.

Asked if a search warrant could be politicized, he said any system “can be corrupted,” but in a case like this, the search warrant affidavit will at some point be public.

“You can seal a search warrant for a period of time. I did it myself, I sealed a search warrant for various reasons related to the security of the case,” he continued. “But it will become public, as will the return, which is what they found. So the affidavit will be exposed.”
